Terms and Conditions of the Training Platform “Wojtek Wiesławski Audio Courses”

§1. Definitions

  1. Platform / Store – an e-learning service available at https://wojtekwieslawski.com/pl/kursy/, enabling the purchase and completion of online courses and webinars (live events).
  2. Seller / Administrator – Wojciech Wiesławski, conducting business activity under the name Wojciech Wiesławski, address: Skrybicze 26g, 15-606 Białystok, NIP (Tax Identification Number): 5451475771, e-mail: [email protected].
  3. User/Customer – a natural person, legal person, or organizational unit without legal personality that uses the Platform.
  4. Consumer – a consumer within the meaning of Article 221 of the Civil Code and a so-called “entrepreneur with consumer rights” (Article 38a of the Consumer Rights Act), provided that they meet the statutory conditions.
  5. Online course – digital content/digital service made available on the Platform (video, audio, text, downloadable files).
  6. Webinar – an online event held on a specific date and time (live training service), with a recording available after the event.
  7. PayU – PayU S.A., a cashless payment operator through which the Customer can pay for their order (payment cards, BLIK, quick transfers, etc.).
  8. PayPal – payment operator PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L‑2449 Luxembourg; enables payments using, among others, account balance, card, bank transfer – in accordance with PayPal’s offer.
  9. Main website – information/marketing website available at https://wojtekwieslawski.com/pl/kursy/
  10. Educational subdomain – registration/login and course/webinar delivery panel available at https://edu.wojtekwieslawski.com, operating on the basis of e-learning provider software (WebToLearn); the subdomain is part of the Platform.
  11. E-learning provider – an entity providing the Administrator with e-learning tools (WebToLearn); acts as a processor within the meaning of the GDPR.

§2. General provisions

  1. The Terms and Conditions define the rules for using the Platform, including: account registration, placing orders, payments, delivery of services, licenses, complaints, and withdrawals.
  2. Use of the Platform is possible after accepting the Terms and Conditions. Creating an account is not mandatory to place an order, provided that the Platform allows purchases “without registration.”
  3. The Administrator shall endeavor to ensure the continuity of the Platform’s operation; technical interruptions related to maintenance/updates are permitted.
  4. During the registration and payment process, the Customer may be redirected from the main Website to the educational Subdomain; both addresses are an integral part of the Platform.
  5. The seller and party to the sales/service agreement is exclusively the Administrator (Wojciech Wiesławski), regardless of the place (URL address) where the agreement was concluded and the payment operators used.
  6. The e-learning provider only provides the technical infrastructure and is not a party to the agreement concluded with the Customer.

§3. Account registration and terms of use

  1. Registration consists of filling out a form (with true and current information) and accepting the Terms and Conditions.
  2. The user is responsible for the security of access to their account (login/password) and should not disclose their login details to third parties.
  3. It is prohibited to: (a) grant access to courses/webinars to third parties, (b) circumvent the Platform’s security measures, (c) distribute content that violates the law or the Terms and Conditions.
  4. The administrator may block an account in the event of a gross violation of the Terms of Service; the user will be notified of this.

§4. Conclusion of the agreement and order

  1. The content presented on the Platform constitutes an invitation to conclude a contract and not an offer within the meaning of the Civil Code.
  2. The contract is concluded upon effective payment for the order by the Customer (payment status “success” in PayU or “completed” in PayPal) or confirmation of acceptance of the order by the Administrator, depending on the method of payment.
  3. After placing an order, the Customer receives an email confirming the purchase. For webinars, the date and time of the event and the rules of participation are indicated.
  4. Registration and payment can be made on the educational subdomain; the redirection does not affect the identity of the Seller or the validity of the contract being concluded.

§5. Prices, invoices, and payments

  1. All prices listed on the Platform are gross prices (including VAT) in Polish zlotys (PLN), unless otherwise indicated.
  2. Available payment methods: PayU (cards, BLIK, quick transfers) and PayPal (PayPal account, card, transfer – in accordance with PayPal’s offer), as well as other methods available on the order page.
  3. The online payment operators are: PayU S.A. (ul. Grunwaldzka 186, 60-166 Poznań) and PayPal (Europe) S.à r.l. et Cie, S.C.A. (22–24 Boulevard Royal, L-2449 Luxembourg). Payments are processed in accordance with the terms and conditions and privacy policies of these operators.
  4. Card payments may require 3-D Secure authorization. If authorization is denied or the transaction fails, the service will not be provided.
  5. We issue VAT invoices electronically after the payment has been credited to our account and make them available in an email or in the customer’s account.
  6. For payments in currencies other than PLN, the exchange rate and any fees are determined by the payment operator (PayU/PayPal) and the card issuer’s bank; the final amount may be converted by the operator.
  7. The e-learning provider acts as a software provider; the Merchant of Record remains the Administrator. All refunds and corrections are made by the Administrator in accordance with these Terms and Conditions.

§6. Delivery of the service / “Delivery time”

  1. Online course (digital content on demand):
    • Access is granted automatically after payment is processed by PayU/PayPal – usually within 15 minutes of the payment being marked as “successful.”
    • In exceptional cases (integration failures, technical interruptions), access will be granted no later than within 24 hours of receipt of payment.
  2. Webinar (live event, specific date/time):
    • We will send you the link/login details for the webinar room at least 24 hours before the start and again on the day of the event (as a reminder).
    • Purchasing after the webinar has started may result in immediate access (if technically possible) or access to a recording after the event, as described in the offer.
  3. Webinar recording/replay:
    • We make the recording available in the Customer’s account within 72 hours after the webinar ends, provided that the offer includes access to the recording.
  4. Payment by traditional bank transfer (if available):
    • The transaction is executed after the funds are credited to the account; the deadline for granting access is calculated as in paragraph 1 from the moment of crediting.
  5. The status of the order is visible in the customer’s account and/or communicated by email.

§7. Change of date, cancellation, and interruption of the webinar

  1. The administrator reserves the right to change the date of the webinar for important reasons (illness of the presenter, infrastructure failure, force majeure). The customer will be immediately informed and offered a new date.
  2. In the event of a webinar being canceled without a new date being set, the Customer may request: (a) a full refund, or (b) a replacement with another webinar/course of equivalent value.
  3. In the event of a webinar being interrupted for technical reasons on the part of the Administrator, a completion date will be set; if this is not possible, a proportional refund will be provided.

§8. Withdrawal from the contract (consumer rights)

  1. Online course as digital content – after granting access (performance of the service), the Customer loses the right to withdraw from the contract pursuant to Article 38(13) of the Consumer Rights Act – provided that they have given their express consent to commence the service before the expiry of 14 days and have acknowledged the loss of the right of withdrawal. Consent is collected during purchase/activation.
  2. Webinar on a specified date – pursuant to Article 38(12) of this Act, the right of withdrawal does not apply to contracts for services related to events on a specified date or during a specified period (training courses, conferences) if the date of the event is specified in the contract.
  3. If the above exceptions do not apply, the Consumer may withdraw from the contract within 14 days without giving any reason by submitting a statement by e-mail to [email protected].

§9. Complaints (performance) and payments

  1. Complaints regarding content/services (e.g., lack of access, material defects) should be reported to [email protected]. The administrator will review the complaint within 14 days and inform you of the outcome.
  2. Complaints regarding payments made via PayU/PayPal can be submitted to the Administrator (address as above). The Administrator may ask the operator to verify the status of the transaction. The customer may also use the PayPal Resolution Center in accordance with PayPal’s terms and conditions.
  3. In the event of an accepted complaint, the Administrator shall ensure: (a) restoration of access, (b) replacement/removal of the defect, (c) a proportional refund of the price, depending on the nature of the defect.

§10. Copyright and license

  1. All materials are protected by copyright and are the property of Wojciech Wiesławski or partners/licensors.
  2. The customer receives a non-exclusive, non-transferable license to use the materials solely for their own educational purposes, within the account, for the period specified in the offer (if not specified – indefinitely, as long as the materials remain available on the Platform).
  3. Copying, public sharing, reselling, re-uploading, and any form of further distribution without the written consent of the Administrator is prohibited.
  4. Recording webinars by Users is not permitted unless the offer/Administrator expressly allows it.

§11. Technical requirements

  1. To use the Platform, you need: a device with Internet access, an up-to-date browser (Chrome, Firefox, Safari, Edge), an active email account, JavaScript and cookies enabled.
  2. Recommended connection: min. 5 Mbps for HD content. For webinars – headphones/speakers, optional microphone.
  3. The User is responsible for meeting the technical requirements.

§12. Liability

  1. The administrator shall not be liable for interruptions in access caused by force majeure, failures on the part of telecommunications service providers, or incompatibility of the User’s environment with the requirements.
  2. The Administrator’s liability for the provision of digital services to entrepreneurs is limited to typical actual damages and does not include lost profits.

§13. Personal data (GDPR)

  1. The data controller is Wojciech Wiesławski. The data is processed for the purpose of order fulfillment, account management, and support, based on the necessity to perform the contract and the legitimate interest of the Controller.
  2. Customers have the right to access, rectify, delete, restrict, transfer data, and object—in accordance with the GDPR. Details can be found in the Privacy Policy available on the Platform.
  3. The administrator entrusts data processing to an e-learning provider (WebToLearn) to the extent necessary to manage accounts, orders, courses, and webinars, based on a processing agreement in accordance with Article 28 of the GDPR.
  4. Data categories: first name, last name, email address, login details, purchase and order history, billing details (including PayU/PayPal transaction IDs). Payment card details are not processed by the Administrator – they are handled by payment operators.
  5. Data recipients: payment operators (PayU/PayPal), e-learning provider, hosting providers, email communication tools (if used) – to the extent necessary to provide services.

§14. Promotions, discount codes, packages

  1. Promotions and discount codes cannot be combined, unless otherwise specified in the terms and conditions of the promotion.
  2. The codes have an expiration date and terms of use indicated at the time of publication.

§15. Amendments to the Regulations

  1. The Administrator may amend the Terms and Conditions for important reasons (changes in law, functionality, payment providers). The Administrator shall notify users of any changes 7 days in advance by email or via a message on the Platform.
  2. The changes are effective as of the date of publication. The customer may terminate the account service agreement if they do not accept the changes.

§16. Dispute resolution

  1. Polish law applies to the agreements.
  2. Disputes with consumers may be resolved out of court – through the relevant provincial inspectorates of the Trade Inspection Authority or the ODR platform: https://ec.europa.eu/consumers/odr.
  3. In disputed matters, the common court shall have jurisdiction in accordance with general principles; in relation to entrepreneurs, the court competent for the Administrator’s registered office shall have jurisdiction.
